Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Acuity Leasing LLC ("Acuity," "we," "us," or "our"), including our web chat widget and SMS messaging service (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including residents and property managers.

2. Description of Service

Acuity provides an AI-powered resident support assistant for multifamily apartment communities. The Service answers common questions about leasing, rent, maintenance, amenities, and community policies via web chat and SMS text messaging. The AI assistant is not a substitute for official communications from your property management company.

3. SMS Terms

  • By texting Acuity's SMS number, you consent to receive automated, AI-generated text message responses.
  • This service is for resident support inquiries only — not marketing.
  • Message frequency varies based on your questions.
  • Message and data rates may apply depending on your mobile carrier plan.
  • To opt out, reply STOP at any time. You will receive one confirmation message and no further messages will be sent.
  • To get help, reply HELP or email garrett@acuityleasing.com.
  • Supported carriers include AT&T, T-Mobile, Verizon, and most major US carriers. Carrier support is not guaranteed for all carriers.

4. AI Limitations

Acuity's AI assistant provides information based on content supplied by your property management company. Responses may not always be complete, current, or accurate. For official lease terms, legal matters, or urgent issues, contact your property management office directly. The AI is not a licensed attorney, financial advisor, or emergency service.

5. Acceptable Use

You agree not to use the Service to:

  • Harass, threaten, or abuse other users or staff
  • Transmit spam, malware, or fraudulent content
  • Attempt to manipulate or jailbreak the AI assistant
  • Use the Service for any unlawful purpose

We reserve the right to terminate access for violations of this policy.

6. Property Manager Accounts

Property managers who register for an Acuity account are responsible for the accuracy of the knowledge base content they provide. You agree not to input false, misleading, or discriminatory information. You are responsible for maintaining the security of your account credentials.

7. Intellectual Property

The Acuity platform, including its software, design, and branding, is owned by Acuity Leasing LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI responses will be accurate or complete.

9. Limitation of Liability

To the fullest extent permitted by law, Acuity shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including reliance on AI-generated responses.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions.
